Decision:
Lifetime ban for improper use of ISMAUK Logo to mislead clients as to Mr Le Clerq’s professional memberships and repeated lack of co-operation with ISMAUK over attempts to bring the situation to resolution.
Reason:
The complainant saw Mr Le Clercq between 2013 and June 2016, believing he was a member of ISMAUK. The complainant received unsatisfactory treatment from Mr Le Clercq which has had lasting effects. After repeated challenges by ISMAUK Mr Le Clerq continued to trade with the ISMAUK logo displayed on the Life Clinic Jersey website.
Evidence:
A complaint was received from a member of the public on 6th April 2020 regarding Cliff Le Clercq of Life Clinic Jersey. Mr Le Clercq was a member of ISMAUK from 2004 – 2008, but no membership payments have been made since, despite annual requests. The evidence is contained in the Reason statement above.
He has not been an ISMAUK member since 2008 and was required to resign. Mr Le Clercq has been repeatedly advised that he should not display the ISMAUK certificate and must remove the ISMAUK logo from his website, in line with the ISMAUK Code of Conduct 2.2, 5.5 and 5.6. No satisfactory reply has been received and Mr Le Clercq has therefore been banned from ISMAUK membership for life.
